Article 1 – Definitions

The following definitions apply to these general terms and conditions:

  • Withdrawal period: the time in which the consumer may exercise the right of withdrawal;

  • Consumer: a natural person not acting in a professional or business capacity, who enters into a distance contract with a trader;

  • Day: A calendar day (Last revision: 26-11-2024);

  • Fixed-term transaction: a distance contract relating to a series of products/services for which the delivery or purchase obligation is spread over time;

  • Durable medium: any means that allows the consumer or trader to store information addressed personally to them in a way that allows future access and reproduction in unaltered form;

  • Right of withdrawal: the consumer's ability to cancel the distance contract during the withdrawal period;

  • Trader: the individual or legal entity offering products and/or services to consumers remotely;

  • Distance contract: an agreement concluded within a system organized by the trader for remote sales of products/services using one or more means of distance communication;

  • Means of distance communication: a method to conclude a contract without simultaneous presence of the consumer and trader;

  • General terms: the trader’s terms and conditions.

Article 3 – Applicability

These general terms apply to all offers made by the trader and to all distance contracts between trader and consumer.

Before the contract is concluded, the text of these terms must be made available to the consumer. If not reasonably possible, the consumer must be informed where the terms can be reviewed and that they will be sent free of charge upon request.

If the contract is concluded electronically, the terms must be provided in a storable format. If this is not possible, the location and means of obtaining the terms must be disclosed beforehand.

If specific product or service conditions apply in addition to these general terms, and there is a conflict, the consumer may always rely on the more favorable provision.

If any part of these terms is found to be invalid or unenforceable, the remainder remains in effect, and the invalid provision will be replaced with a valid one reflecting the original intent.

Situations not covered must be interpreted in the spirit of these terms.

Any ambiguities must be interpreted in the spirit of these terms.


Article 4 – Offer

If an offer has limited validity or is conditional, this will be clearly stated.

Offers are non-binding; the trader may change or adjust them.

Offers will accurately describe products/services. Images used must truthfully represent products. Obvious errors are not binding.

Images, specifications, and data are for reference and do not justify claims or cancellation.

Product images are representative, but color accuracy is not guaranteed.

Each offer includes clear terms regarding:

  • Prices (excluding customs clearance and import VAT, which are borne by the customer);

  • Shipping costs;

  • Contract formation steps;

  • Right of withdrawal applicability;

  • Payment, delivery, and execution terms;

  • Offer validity period;

  • Communication costs if different from standard;

  • Contract storage and access;

  • Correction methods for entered data;

  • Languages for contract;

  • Applicable codes of conduct;

  • Minimum contract duration for fixed-term contracts.


Article 5 – The Contract

The contract is concluded once the consumer accepts the offer and meets its conditions.

For electronic offers, confirmation is sent electronically; until then, the consumer may cancel.

Traders must ensure secure data transmission and environment. Electronic payments require adequate protection.

The trader may assess creditworthiness and deny or adjust orders with justification.

Upon contract conclusion, the trader provides the consumer with:

  • Business address for complaints;

  • Withdrawal process and, if applicable, exceptions;

  • Warranty and after-sales service details;

  • Information from Article 4(3), unless previously provided;

  • Termination conditions if the contract lasts more than one year or is indefinite.

Contracts are subject to product availability.


Article 6 – Right of Withdrawal

Consumers can withdraw from product purchases within 30 days without stating a reason, starting the day after receiving the item.

During this period, the consumer must handle products and packaging carefully—only as needed to assess them.

To exercise the right of withdrawal, the consumer must notify the trader in writing or by email within the 30-day window and return the item within another 30 days, retaining proof of return (e.g., shipping receipt).

If the consumer fails to notify or return the item in time, the purchase becomes final.


Article 7 – Costs of Withdrawal

Consumers bear the return shipping costs.

If payment has already been made, the trader must issue a refund within 30 days of the withdrawal, provided the returned item has been received or return proof is presented.


Article 8 – Exclusion of Right of Withdrawal

The right of withdrawal may be excluded for:

  • Custom-made products;

  • Clearly personal items;

  • Items unsuitable for return due to their nature;

  • Perishable or dated goods;

  • Items with price fluctuations beyond the trader’s control;

  • Newspapers and magazines;

  • Unsealed audio/video/software;

  • Unsealed hygienic products.

Also excluded:

  • Accommodation, transport, catering, or leisure for a specific date/time;

  • Services started with consent before withdrawal period ended;

  • Gambling and lotteries.


Article 9 – Prices

Prices remain fixed during the offer period, except for VAT rate changes.

Prices subject to financial market fluctuations may vary and must be disclosed as indicative.

Price increases within 3 months post-contract are only allowed due to legislation.

Increases after 3 months require consumer consent.

Price listing errors do not bind the trader.


Article 10 – Conformity and Warranty

Products/services must match the contract, offer specifications, reasonable usability expectations, and applicable laws.

Warranty from the trader/manufacturer/importer does not affect the consumer’s statutory rights.

Defective or incorrect products must be reported in writing within 30 days. Returns must be in original packaging and condition.

Warranty does not apply if:

  • The consumer or a third party altered the item;

  • The product was mishandled or exposed to unsuitable conditions;

  • The defect results from government-imposed regulations.


Article 11 – Delivery and Performance

The trader handles orders with care.

Orders must be delivered within 30 days, unless otherwise agreed. Delays or partial fulfillment must be communicated within 30 days, and the consumer may cancel with a full refund.

If an ordered product is unavailable, a substitute may be delivered. This will be clearly stated. Substitutes do not void the right of withdrawal. Return shipping is covered by the trader.

Risk of damage/loss transfers to the consumer upon delivery unless otherwise agreed.


Article 12 – Duration of Agreement: Termination and Renewal

Termination

Consumers may cancel indefinite contracts with one month’s notice.

Fixed-term contracts for regular supply may be terminated at the end of the term, with one month’s notice.

Termination must be possible:

  • At any time;

  • In the same manner the contract was formed;

  • With the same notice period the trader requires.

Renewal

Fixed-term product/service contracts may not be automatically renewed.

Newspaper/magazine subscriptions may be auto-renewed for up to three months with one month’s notice for termination.

Ongoing renewals are only valid if the consumer may cancel at any time with up to one month’s notice (or three for non-monthly publications).

Trial subscriptions end automatically unless otherwise agreed.

Duration

Contracts over one year may be canceled after 12 months with one month’s notice unless fairness demands otherwise.


Article 13 – Payment

Unless otherwise agreed, consumers must pay within 7 business days from the start of the withdrawal period.

For service contracts, this period begins upon contract confirmation.

Consumers must report payment detail errors immediately.

Late payments may incur lawful and previously disclosed costs.


Article 14 – Complaints

Complaints must be submitted within 7 days of discovering a defect, with a clear description.

Complaints receive a reply within 14 days. If more time is needed, a confirmation and timeline will be provided.

Unresolved complaints may lead to disputes.

Filing a complaint does not suspend contractual obligations unless agreed.

Valid complaints may result in repair or replacement at the trader’s discretion.


Article 15 – Disputes

Contracts governed by these terms are subject exclusively to Dutch law, even for consumers residing abroad.


Article 16 – VAT and Import Charges

Prices do not include customs or import VAT. These costs are the consumer’s responsibility.

Postal/courier services will apply relevant customs regulations and may collect VAT and customs fees directly from the recipient.

Delivery falls under Article 5(1) of the Dutch VAT Act 1968, meaning the trader does not charge VAT, but the consumer pays it in their own country.


Article 17 – Legal References and Compliance

All transactions comply with European and national laws, including the CESOP system (effective 2024) for centralized electronic payment information reporting.

If payment data is collected by payment providers, it may be logged in CESOP to ensure tax compliance, in accordance with EU and national directives.
